Adverse Possession - In common law, adverse possession is the process by which title to another's real property is acquired without compensation, by, as the name suggests, holding the property in a manner that conflicts with the true owner's rights for a specified period of time.The law of adverse possession is entirely statutory, arising out of a statutory limitation period or statute of limitations.

Declarant - The person who files a declaration under ORS 92.075.

Declaration - The instrument by which the subdivision or partition plat was created.

Delineation - To draw or trace the outline of; sketch out. To depict in words or gestures. In Land use it normally applies to the defining of a wetland area by an expert.

Density – The density of development allowed on the property such as the number of residential homes than can be constructed per acre. The higher the density allowed, the more units allowed. Density calculations are different from zone to zone and from jurisdiction to jurisdiction

Design Review – The process of discretionary review of plans and proposals for land use, building design, and site development to promote, preserve and enhance the visual quality and character and policies of the jurisdiction

Easement - The right to do something or the right to prevent something over the real property of another.

Feasibility study - A preliminary study undertaken to determine and document a project's viability. The results of this study are used to make a decision whether to proceed with the project, or table it.

Lot - A single unit of land that is created by a subdivision of land.

Lot Segregation – The creation of a new tax lot by the re-establishment of an originally platted lot line.

Negotiate - Any activity preliminary to the execution of a binding agreement for the sale of land in a subdivision or partition, including but not limited to advertising, solicitation and promotion of the sale of such land.

Parcel - A single unit of land that is created by a partition of land.

Partition - Either an act of partitioning land or an area or tract of land partitioned.

Partition land - To divide land to create two or three parcels of land within a calendar year.

Partition plat - A final map and other writing containing all the descriptions, locations, specifications, provisions and information concerning a partition.

Plat - A final subdivision plat, replat or partition plat.

Property line - The division line between two units of land.

Property line adjustment (PLA) - The relocation or elimination of a common property line between abutting properties.

Real property - is a legal term encompassing real estate and ownership interests in real estate (immovable property). It is a type of property differentiated from personal property.

Replat - The act of platting the lots, parcels and easements in a recorded subdivision or partition plat to achieve a reconfiguration of the existing subdivision or partition plat or to increase or decrease the number of lots in the subdivision.

Road or street - A public or private way that is created to provide ingress or egress for persons to one or more lots, parcels, areas or tracts of land, excluding a private way that is created to provide ingress or egress to such land in conjunction with the use of such land for forestry, mining or agricultural purposes.

Sale or sell - includes every disposition or transfer of land in a subdivision or partition or an interest or estate therein.

Setbacks - how close buildings can be constructed to property lines, rivers/streams, and wetlands. Setbacks vary by zoning area or district

Subdivide land - To divide land to create four or more lots within a calendar year.

Subdivision - Either an act of subdividing land or an area or a tract of land subdivided.

Subdivision plat - A final map and other writing containing all the descriptions, locations, specifications, dedications, provisions and information concerning a subdivision.

Utility easement - An easement noted on a subdivision plat or partition plat for the purpose of installing or maintaining public utility infrastructure for the provision of water, power, heat or telecommunications to the public.

Variance - In land use, a variance is a requested deviation from the set of rules a municipality applies to land use known as an ordinance, building code or municipal code.
